LEASING PACKET
The leasing of a Unit in the Gold Coast Galleria Condominium Association is subject to the requirements of Section 21 of the Declaration, the Rules and Regulations, and applicable City of Chicago ordinances. Also, the Association requires the submission of an executed lease and a completed informational packet and lease rider that can be obtained from the management office.
Provided Unit Owners comply with the requirements of the Illinois Condominium Property Act, Section 21 of the Declaration, the By-Laws and the Rules, nothing contained below is intended to suggest that the Board need give its permission/approval to the Unit Owner to lease his or her Unit.
- Each lease of any one or more Units shall be in writing. A copy of every such signed lease shall be delivered by the Unit Owner to the Management Office not later than the date of unit occupancy or ten days after the date the lease is signed, whichever occurs first. No lessee may occupy a Unit until such time as the Management Office has been supplied a copy of the lease. The Association may prohibit a tenant from occupying a Unit until the Unit Owner complies with the leasing requirements prescribed by these rules.
- Each lease must have attached a signed lease packet and rider. These forms can be obtained from the Management office. The rider confirms the lessees receipt and understanding of the Association Declaration, By-laws, and Rules. Regardless of whether such a provision is contained in the lease, however, the lessee shall be so bound. The Association may file suit against a lessee or his or her Unit Owner and terminate the lease for any breach by the lessee of the Declaration, By-Laws, or Rules. No lease may be entered into by a prior lessee of this building who has been either previously evicted or subject to eviction proceedings.
- In making any lease, the Unit Owner is not relieved of any obligations under the Declaration, By-Laws, or Rules including but not limited to payment of assessments.
- No portion of a Unit, which is less than the entire Unit, may be leased.
- No lease, assignment of lease, or sublease of any Unit may be for hotel or transient purposes or for a term of less than six (6) months, except as specifically provided in the Declaration.
- Every lease shall expressly provide that the tenant shall use the Unit only for residential purposes (as provided in Section 21 of the Declaration and By-Laws).
- The tenant must contact the Management office to reserve elevator time for the move in.
- Twenty days in advance of moving in, a $500 check for the non-refundable $350 moving fee and the non-refundable $150 administrative fee, and a $100 check for the refundable elevator security deposit must be submitted to the Management Office. 20 days in advance of transferring to another unit, a $250 check for the non-refundable moving and administrative fees, and a $100 check for the refundable elevator security deposit must be submitted to the Management Office. 20 days in advance of moving out, a $100 check for the non-refundable fee, and a $100 check for the refundable elevator security deposit must be submitted to the Management Office. Whether moving in, moving out, or transferring, provided that no damage has occurred, the security deposit check will be voided and destroyed. These fees are subject to change at any time as deemed appropriate by the Board of Directors.
Forms for acceptance of the rules, and other matters are available from the Management Office. Leases, upon submission of complete documentation, are subject to Association approval and tenants may not occupy the premises prior to this approval. Leases used must be standard form condominium (not apartment) leases; the Management Office has such leases available for use by Unit Owners and Renters and must be obtained directly from the office at 111 West Maple. Unit owners are responsible for providing tenants with a copy of the Association’s Declaration and Bylaws and Rules and Regulations, as well as their tenants’ compliance with it.
A copy of the Leasing Packet can be made available by the Management Office within 24 hours to any Unit Owner or authorized agent of a Unit Owner, or resident. Once all the materials specified in the cover letter of the packet are gathered, they can be faxed to 312-482-9795, or dropped off in the Management Office, and the lease will be processed.
